Terms of Service
Last updated: September 14, 2026
These Terms of Service (the "Terms") govern your use of the website at https://mindandmood.org (the "Site") and the counseling and therapy services offered by [LEGAL ENTITY NAME – TODO] ("Mind & Mood", "we", "us").
Please read them carefully. By using the Site, creating an account or booking a session, you agree to these Terms and to our Privacy Policy.
1. Acceptance of these terms
Using the Site, creating an account or booking a session means you accept these Terms. If you do not agree with them, please do not use the Site or our services.
2. Eligibility
You must be at least 18 years old and able to enter into a binding agreement to use our services. The booking form asks you to confirm this. If you are a parent or guardian seeking support for someone under 18, contact us before booking.
3. Our services
We offer counseling and therapy sessions with mental health professionals, delivered online through a video link or in person at our facility. We also offer a free 25-minute evaluation session to discuss your situation and whether counseling or therapy is suitable for you.
The evaluation session is informational. It is not a diagnosis or treatment, and it does not by itself create an ongoing therapeutic relationship. We may change or discontinue services, and will tell you if this affects a booking you have made.
4. Not an emergency service
Mind & Mood is not an emergency or crisis service and is not available around the clock. If you are in immediate danger, thinking about harming yourself or someone else, or need urgent medical help, contact your local emergency number or go to the nearest emergency department right away.
Please do not use the booking system, email or social media to report an emergency.
5. Accounts
An account is optional; you can book sessions without one. If you create an account, you agree to:
- Provide accurate information and keep it up to date
- Keep your password confidential and not share your account
- Tell us promptly if you believe your account has been accessed without permission
You are responsible for activity that takes place under your account. We may suspend or close accounts that are used in breach of these Terms.
6. Booking, rescheduling and cancellation
Sessions are booked through our scheduling provider, Cal.com. Your confirmation email contains the meeting link for online sessions and links to reschedule or cancel.
Please give us as much notice as possible if you need to change or cancel a session. Sessions cancelled with less than [24] hours' notice, or missed without notice, may be charged at the full rate ([CANCELLATION POLICY – TODO]).
Occasionally we may need to reschedule a session. If so, we will tell you as soon as possible and offer an alternative time.
7. Fees and payment
The evaluation session is free of charge. Fees for other sessions are shown when you book or communicated to you before the session. Payment is collected through our booking or payment provider, or as otherwise agreed with you.
We may offer discounted rates based on your circumstances. Discounts are at our discretion and may be reviewed over time.
Fees for sessions that have taken place are non-refundable. Refunds for other situations are handled case by case ([REFUND POLICY – TODO]).
8. Your responsibilities
To get the most out of your sessions and keep them safe for everyone, you agree to:
- Provide accurate information about yourself
- Join online sessions on time, from a private and safe place, with a reliable internet connection
- Treat our team with respect
- Not record sessions without the express consent of your therapist
- Follow reasonable guidance from your therapist about the therapeutic process
9. Confidentiality and its limits
What you share in sessions is confidential. Your therapist may only disclose information without your consent in limited situations, including:
- A serious risk of harm to you or to another person
- Suspected abuse or neglect of a child or vulnerable adult, where reporting is required
- A court order or other legal obligation
Your therapist will discuss these limits with you. With your written consent, information may also be shared with people you nominate, such as another healthcare provider.
10. Informational content is not medical advice
Content on the Site and on our social media accounts is general information reviewed by mental health professionals. It is not a substitute for an individual assessment, diagnosis or treatment. Do not disregard professional advice, or delay seeking it, because of something you have read on the Site.
11. Intellectual property
The Site, its content, our name and logo belong to Mind & Mood or our licensors. You may use the Site for your personal, non-commercial use only and may not copy, modify or distribute our content without permission.
12. Third-party services
We rely on third-party services, including Cal.com for booking, video meeting providers for online sessions, Google Firebase for accounts and PostHog for analytics (with your consent). Their availability is outside our control, and their own terms apply to your use of them. If a technical problem prevents a session from taking place, we will offer to reschedule.
13. Disclaimers and limitation of liability
The Site is provided on an "as is" basis. Therapy outcomes depend on many factors and we cannot guarantee a particular result.
To the extent permitted by law, our liability to you in connection with the Site or a session is limited to the fees you paid for the session concerned. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for professional negligence where applicable.
14. Suspension and termination
You may stop using our services at any time. We may decline or discontinue services where they are no longer clinically appropriate, where these Terms are breached, or where our team's safety is at risk. Where possible, we will suggest alternative sources of support.
15. Governing law
These Terms are governed by the laws of [JURISDICTION – TODO]. Any dispute will be resolved by the courts of [JURISDICTION – TODO], unless applicable law gives you the right to bring a claim elsewhere.
16. Changes to these terms
We may update these Terms from time to time. The latest version is always available on this page with the date it was last updated. Continuing to use the Site or our services after a change means you accept the updated Terms.
